Privacy Policy

KiddsKastle LLC ("Grein," "we," "us") provides the Grein Outdoors application and the website at mygrein.com. This policy explains what Grein collects, why, the legal bases we rely on, and the choices you have. You can change any of these choices at any time in Settings → Privacy & data.

Information we process

  • Your account — your email address and a password (stored hashed by our auth provider), plus your confirmation that you are 13 or older (a checkbox and the time you confirmed it). We do not collect a date of birth.
  • Your content — plants, photos, notes, saved species, garden plans, and map tags you create.
  • Location — when you enable it, your device position powers map follow-me, distances, tagging, and breadcrumb tracks. This can include your GPS location and, if you turn it on, your location history. You control this with the location permission and the "Record location history" toggle.
  • Photos — when you scan or diagnose a plant, the photo is sent to our third-party identification provider (Plant.id / Kindwise) to return a result. This only happens when you have turned on "Send my photos to our identification provider."
  • Analytics & diagnostics — off by default. We only collect anonymous usage and diagnostic data if you opt in under Settings → Privacy & data.

How we use your information

We use your information to provide and secure the Service — to run your account, sync and back up your content, identify plants you choose to scan, power the map and location features you enable, respond to support requests, and comply with our legal obligations. We do not use your information for advertising.

Legal bases for processing

Where data-protection laws such as the GDPR apply, we rely on the following legal bases:

  • Consent — for example, sending the photos you choose to scan or diagnose to our identification provider, recording location history, and collecting analytics. You can withdraw your consent at any time in Settings → Privacy & data.
  • Performance of a contract — to provide the account, sync, and core features you ask us for.
  • Legal obligation — to comply with laws that apply to us.
  • Legitimate interests — to keep the Service secure, prevent abuse, and improve reliability, where those interests are not overridden by your rights.

Cookies and tracking technologies

Grein uses only the storage and cookies needed to run the app and remember your preferences — for example, keeping you signed in, storing your consent choices, remembering your theme and accent color, and caching content and offline map areas on your device. We do not use advertising cookies, and we do not use third-party ad networks or cross-site tracking technologies. You can clear this data through your browser or device settings, though doing so may sign you out or reset your preferences.

Third parties

  • Identification provider (Plant.id / Kindwise) — receives the photo you choose to scan or diagnose and returns species and health information. See their own policy for how they handle images.
  • Hosting and infrastructure (Supabase) — stores your account and content in our cloud database and file storage.
  • Payment and app-store processors — handle billing if you buy a subscription.

We do not sell your personal information.

Third-party links

Grein may link to third-party websites and resources — for example, an identification provider's site or an external reference. We are not responsible for the content or privacy practices of those sites. Please review the privacy policy of any third-party site you visit.

International data transfers

Grein is operated from the United States, and our providers may process and store your information in the United States and in other countries whose data-protection laws may differ from those where you live. Where required, we take steps to ensure appropriate safeguards for such transfers. By using the Service, you understand that your information may be transferred to and processed in the United States.

Data retention

We keep your information for as long as your account is active or as needed to provide the Service. When you delete your account, we delete your account and its associated content; some records may persist briefly in backups or where retention is required by law.

Your choices and rights

  • Permissions — grant or revoke Location, Camera, Photos, and Notifications from Settings and from your OS or browser settings.
  • Export — download a copy of your data as JSON from Settings → Privacy & data.
  • Delete — permanently remove your account and all associated data at any time.
  • Location history — view and delete individual tracks, or clear all location history.
  • Consent — turn photo identification, location history, and analytics on or off at any time.

Depending on where you live, you may also have rights to access, correct, or object to how we process your information. Contact us to exercise them.

Children

Grein is not directed to children under 13. Instead of collecting a date of birth, we ask you to confirm at sign-up that you are at least 13, and we record that confirmation. See the Terms of Service for the minimum age.

Changes to this policy

We may update this policy from time to time. When changes are material, we will update the version and effective date shown at the top of this document. Continued use of the Service after an update means you accept the revised policy.

Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and KiddsKastle LLC ("Grein," "we," "us," or "our"), the company that provides the Grein Outdoors application and the website at mygrein.com (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Acceptance of these terms

By creating an account, or by accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

2. Eligibility and age

You must be at least 13 years old to use Grein. When you sign up, you confirm that you are 13 or older by checking "I am 13 years of age or older," and we record that confirmation with a timestamp. We do not collect a date of birth. Accounts for anyone under 13 are not permitted, and if we learn that an account belongs to someone under 13 we may remove it.

3. Important safety disclaimer

Grein is an informational and educational tool only. It is not a source of safety, medical, foraging, or navigation decisions. Read this section carefully before relying on anything in the app.

  • Never consume, handle, or use any plant or fungus based on Grein. Plant and mushroom identification is difficult, look-alikes are common, and misidentification can cause serious illness or death.
  • Before you eat, touch, harvest, or otherwise use any plant or fungus, independently verify its identity with a qualified expert and multiple reliable sources. Do not treat a Grein result as confirmation.
  • Any edibility, medicinal, toxicity, or pet-safety information in Grein is general information only and is not medical, health, veterinary, or other professional advice. Consult a qualified professional before acting on it.
  • Plant health and disease "diagnoses" in Grein are automated estimates generated by software. They can be wrong and are not a substitute for a professional diagnosis.
  • The maps, compass, headings, GPS position, and other location features in Grein are not navigation or safety devices. Accuracy varies and can be poor, location tracking can stop in the background without warning, and offline maps only cover areas you have downloaded in advance. Do not rely on Grein to navigate or to find your way to safety. When you go outdoors, carry a physical map, a compass, and a real emergency beacon or communication device.
  • You are responsible for lawful and safe access to any location, including land access and permission, seasonal closures, protected species and areas, and any permits or licenses required for foraging, collecting, or other activities.
  • Outdoor activities carry inherent risks. You assume all risk arising from your use of the Service and from any outdoor activity, and you are solely responsible for your own safety and decisions.

4. Your account

You are responsible for the information you provide and for keeping your password secure. You are responsible for activity that occurs under your account. Please tell us promptly at [email protected] if you believe your account has been accessed without your permission.

5. Acceptable use

  • Provide accurate account information and keep your credentials secure.
  • Do not misuse the Service, interfere with or disrupt it, or attempt to access it in unauthorized ways.
  • Do not infringe others' rights or upload unlawful, harmful, or infringing content.
  • Do not use the Service to break the law, including laws on land access, protected species, foraging, and collecting.
  • Remember that identification and health suggestions are informational only and can be wrong; do not rely on them for consumption, medical, foraging, or safety decisions (see Section 3).

6. Your content and license

You keep ownership of the plants, photos, notes, garden plans, map tags, and other content you add ("Your Content"). You grant us a limited, non-exclusive license to store, process, display, and back up Your Content solely to operate and provide the Service to you — including sending photos you choose to scan or diagnose to our third-party identification provider, as described in the Privacy Policy. You are responsible for Your Content and confirm that you have the rights necessary to add it.

7. Subscriptions, trials, and payments

Grein offers a free tier and paid subscriptions (billed monthly or yearly), and may offer one-time purchases such as individual scans. Paid plans may begin with a free trial; unless you cancel before the trial ends, the plan converts to a paid subscription. Subscriptions renew automatically until cancelled. You may cancel at any time, effective at the end of the current billing period. Except where required by law, payments are non-refundable. Prices may change with notice for future billing periods. Purchases made through a third-party app store are also subject to that store's terms.

8. Intellectual property

The Service — including its software, design, branding, and the content we provide (excluding Your Content and third-party data) — is owned by KiddsKastle LLC or its licensors and is protected by law. We grant you a personal, non-transferable, revocable license to use the Service under these Terms. Species and map data may come from third-party sources subject to their own terms.

9. Disclaimer of warranties

The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. To the fullest extent permitted by law, we disclaim all such warranties.

Without limiting the above, we do not warrant that any identification is accurate, or that any plant, fungus, animal, or other species identified, described, or shown in Grein is safe to consume, handle, or use. We do not warrant that species information, health diagnoses, maps, headings, or location data are accurate, complete, current, or reliable, or that the Service will be uninterrupted, secure, or error-free.

10. Limitation of liability

To the fullest extent permitted by law, in no event will KiddsKastle LLC or its owners, employees, or suppliers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of the Service.

This includes, without limitation, any illness, injury, or death arising out of or relating to your reliance on any identification, health diagnosis, map, compass heading, GPS or location data, or other information provided through the Service.

To the fullest extent permitted by law, our total aggregate liability for all claims arising out of or relating to the Service will not exceed the greater of (a) the total amount you paid us for the Service in the twelve (12) months before the event giving rise to the claim, or (b) fifty U.S. dollars (US$50). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless KiddsKastle LLC and its owners, employees, and suppliers from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, Your Content, or your violation of these Terms or of any law or third-party right.

12. Termination

You may delete your account at any time in Settings → Privacy & data, which removes your account and its associated content. We may suspend or terminate access if you violate these Terms or to protect the Service or other users. Provisions that by their nature should survive termination — including Sections 3, 6, 9, 10, and 11 — survive.

13. Changes to these terms

We may update these Terms from time to time. When changes are material, we will update the version and effective date shown at the top of this document and may ask you to accept the revised Terms. Continued use of the Service after an update means you accept the revised Terms.

14. Governing law and jurisdiction

These Terms are governed by the laws of the State of Louisiana, United States, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Louisiana have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, and you consent to venue there, except where applicable law provides otherwise.
